Actually, it is. Sex in Public is a real grey area. It is not illegal if the participants have a reasonable assumption that they won't get caught. If they are in a place to cause "shock" value, it is. ie:Cum on on one's face in public. Of course, the cops have to be called which wouldn't happen in your picture unless there were undercover looking to hurt someone.
